1. General

BayPilot provides route planning, weather preview and map tools. By using the Service you accept these Terms.

BayPilot features may change, become temporarily unavailable, be improved, limited, or removed without prior notice where necessary for maintenance, security, or service development.

2. Safety disclaimer

BayPilot is an auxiliary tool. Outputs (routes, duration, weather) may be incomplete or incorrect. You are fully responsible for navigation and safety decisions.

BayPilot is an auxiliary tool for route planning, weather, and boating information. BayPilot does not replace official nautical charts, pilot books, navigational notices, weather forecasts, safety equipment, common sense, or the captain’s judgment.

Routes, recommendations, forecasts, POIs, and other data may be inaccurate, incomplete, delayed, or unavailable. The user bears full responsibility for navigation decisions and voyage safety.

BayPilot is a simple route planner and an auxiliary tool for preliminary voyage planning. It is not a navigation system intended for professional or operational vessel guidance and must not be used as the sole source of data for navigation, obstacle avoidance, fairway guidance, bridge clearance assessment, depth, vessel traffic, or safety decisions.

3. Account and trial

  • Trial access may be time-limited.
  • Registration may require email verification and CAPTCHA.
  • BayPilot is currently free to use unless clearly stated otherwise for a specific feature or offer.
  • Using the free version of BayPilot does not mean that all features will remain continuously available; features may be developed, limited, withdrawn, or conditionally offered.

Free access to BayPilot does not change the nature of the Service as a simple auxiliary tool for route planning and viewing information, rather than a navigation system intended for vessel guidance.

4. Prohibited use

  • Abusing the API, automated scraping, bulk data extraction, or bypassing limits.
  • Security violations, attempts to access other users’ accounts, or disrupting the Service.

4a. Liability and third-party data

BayPilot relies in part on external data and services, including map, weather, geolocation, and other technical data. Such data may be incomplete, delayed, inaccurate, or temporarily unavailable.

To the fullest extent permitted by law, BayPilot is not liable for damages resulting from the use of the Service as a substitute for proper navigation, official navigational publications, current notices, observation of surroundings, safety equipment, or the captain’s decisions.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

4b. User-added POIs

Users may add their own POIs, including anchorages, marinas, buoys, and other voyage-related places. Such information should be added in good faith, in line with the best available knowledge, and in a way that does not mislead others.

Adding false, spammy, offensive, or misleading content is prohibited. BayPilot may remove, hide, or limit the visibility of such content.

POIs and other user-added information are provided for informational purposes only. BayPilot does not guarantee their accuracy, completeness, or timeliness and is not responsible for reliance on them.

4d. Information about places, businesses, and POIs

BayPilot may display information about places, marinas, ports, local services, businesses, and other POIs visible on the map.

This information may come from different sources, including in particular:

  • publicly available information, such as official websites of businesses, marinas, ports, or institutions;
  • data from OpenStreetMap, Geofabrik, Geoapify, and other open data sources;
  • licensed data provided by third-party suppliers;
  • information provided directly by business owners, ports, marinas, or their authorized representatives;
  • proposals and reports submitted by BayPilot users;
  • information obtained by BayPilot through contact with local businesses or service operators.

4e. User suggestions for changes

A registered user may suggest a change to information about a place, for example the place name, category, map location, address, phone number, website, opening hours, available services or amenities, place status, photos, or other materials related to the place.

A user suggestion is not published automatically. Each submission will be reviewed by a BayPilot administrator before publication. The administrator may approve the submission in full, approve only part of the changes, or reject it.

By submitting photos, videos, POI data corrections, descriptions, or other materials through the “Suggest changes” form, the user declares that they own the rights to the submitted materials or are authorized to make them available.

The user confirms that the submitted materials are original or have been submitted with the consent of the rights holder. It is prohibited to submit materials taken from other services, apps, maps, social media platforms, restaurant websites, review services, image search engines, or other sources unless the user has an express right to use them.

As a rule, BayPilot accepts only original photos taken by the user or provided with the express consent of the authorized rights holder. Photos should not contain logos, watermarks, business marks added to the image, advertising elements, or other marks suggesting that the material comes from someone else’s website or service.

It is prohibited to submit screenshots, screen captures, frames from videos, photos downloaded from the internet, maps, webcams, social media platforms, review services, image search engines, or other public sources unless the user has an express right to use and publish them in BayPilot. A photo should not be a copy of material already available on the internet.

If the submitted materials show identifiable people, the user confirms that they have the required consent from those people to submit, store, publish, and display the materials in BayPilot.

Users should not submit photos showing recognizable people unless they have their consent. This applies in particular to photos of faces, people in private situations, crews, marina guests, venue customers, and other people who can be identified from the photo or its context.

The user grants BayPilot a non-exclusive, free, worldwide license to store, copy, technically process, create thumbnails from, moderate, publish, and display the submitted materials in the BayPilot app, on baypilot.app, and in related BayPilot services.

The user confirms that the submitted materials do not infringe third-party rights, including copyrights, image rights, privacy, personal data protection, trademarks, or other intellectual property rights.

BayPilot may refuse to publish, remove, or hide submitted materials if it considers them incorrect, outdated, unlawful, infringing third-party rights, violating another person’s privacy, or inconsistent with these Terms.

Submitting materials does not guarantee publication. Materials may require approval by an administrator.

4f. Business owner or authorized representative

If a user marks the option “I am the owner of this business or a person authorized to represent it,” the submission may be treated as an owner claim.

BayPilot may request additional verification, for example:

  • a message sent from a company email address;
  • a link to the official business website;
  • a document or other proof of authorization;
  • phone or email contact with the business, marina, port, or place operator.

Merely selecting this option does not automatically grant control over the listing and does not automatically publish the changes.

4g. Legal reports

Legal reports concerning places, businesses, POIs, photos, descriptions, or other content visible in BayPilot should be submitted through the “Report a legal issue” form.

This form is intended in particular for reporting:

  • privacy or personal data violations;
  • copyright infringement;
  • trademark infringement;
  • unlawful use of a company name, logo, or other marks;
  • false or defamatory information concerning a person, company, or place;
  • content covered by a court order or another decision of a competent authority;
  • requests to remove or limit visibility of content for legal reasons.

A legal report should include a description of the issue, identification of the place or content concerned, the reporter’s contact details, and, where possible, documents or information supporting the basis of the report.

BayPilot may ask the reporter for additional information needed to verify the report. After review, BayPilot may remove the content, limit its visibility, correct the data, reject the report, or take other appropriate actions in accordance with the law and these Terms.

4h. User reviews and ratings

A registered user may add a review or rating for a place visible in BayPilot, such as a marina, anchorage, restaurant, shop, service point, fuel station, tourist attraction, or another POI.

A review or rating should be based on the user’s genuine experience, an actual visit, use of a service, or reliable information about the place. Reviews and ratings should relate only to the place to which they are assigned.

It is prohibited to add reviews or ratings that:

  • are false, manipulated, purchased, or added to artificially increase or decrease a place’s rating;
  • are not based on the user’s real experience;
  • were added in exchange for payment, a discount, a free service, a gift, or another benefit;
  • result from a conflict of interest, for example were added by an owner, employee, competitor, or person connected with the place, where the review pretends to be an independent customer review;
  • do not concern the relevant place or relate to private disputes, political, social, advertising, or other topics unrelated to the place;
  • contain defamation, baseless accusations, threats, personal attacks, harassment, offensive content, or hate speech;
  • disclose private data of third parties without their consent;
  • contain spam, advertising, promotional links, or content added mainly to promote another service, business, or website;
  • are added in bulk, from multiple accounts, or in a way intended to manipulate a place’s rating.

BayPilot may refuse to publish, hide, remove, or limit the visibility of a review or rating if it considers that it violates these Terms, the law, third-party rights, fair use of the Service, or may mislead other users.

BayPilot may also temporarily or permanently restrict the ability to add reviews and ratings for a user who adds false, spammy, offensive, irrelevant content, or takes actions intended to manipulate place ratings.

User ratings and reviews are informational. BayPilot does not guarantee their truthfulness, completeness, or timeliness.

4c. Availability and no warranty

BayPilot is provided as is and as available. We do not guarantee uninterrupted operation of the Service, continuous availability of all features, absence of errors, or that the Service will fully meet the user’s expectations.

Data, outputs, calculations, forecasts, map layers, route suggestions, and other information presented in BayPilot may be incomplete, approximate, delayed, or incorrect, especially where they come from external providers or computational models.

To the fullest extent permitted by law, BayPilot makes no express or implied warranties regarding fitness for a particular purpose, data accuracy, feature availability, or the results of using the Service.

5. Account deletion

You can delete your BayPilot account by logging in to the BayPilot web app:

If you are not logged in, click “Log in” and sign in with the email address connected to your BayPilot account.

Then go to:

Account → Security → Delete account

For OAuth accounts, such as Google or Facebook, account deletion may require additional confirmation through a link sent to the email address associated with the account.

If you cannot access your account, contact us from the email address associated with your BayPilot account:

support@baypilot.app

After account deletion, your data will be deleted or anonymized unless further retention is required by law or necessary to protect legitimate claims.
